This study of certain early judicial punishments in New Zealand, and the enviroment in which they were awarded and then carried out, arises from uncertainties surrounding the notion of "penal servitude". What were the origins of this punishment; who were its authors; what distinuguished it from the more easily understood imprisonment, with or without hard labour; what were the offences, or perhaps circumstances, that had produced it?
